Nepal: Court Marriage Requirements and Details

Marriage is defined as the voluntary union between two opposite genders who accept each other as husband and wife through any occasion, ceremony, formal, or any other act recognized by law. It establishes legal and social relationships between two individuals.  Section 67-84 of The National Civil (Code) Act, 2017 provides all the details regarding the procedure to be followed in marriage. We now will help you to know the details about the provision regarding registering the marriage in Nepal.

Requirement for a Marriage

(a) If the man and the woman agree to accept each  other as husband and wife,
(b) If the man and the woman are not relatives,  punishable by law on incest,
(c) If a matrimonial relationship of both the man and the  woman does not exist,
(d) If both have attained twenty years of age.
However, the law allows marriage in certain ethnic groups to be married to one’s relative if they culturally accept such practice.

 

Documents required for Marriage registration in Nepal

  1. Application for registration,
  2. Letter from the ward office that the concerned male and female are unmarried or divorced,
  3. Passport-size photos (4/4) of males and females who are going to marry,
  4. Citizenship of male and female who are going to marry,
  5. Citizenship of parents of male and female who are going to marry, (not compulsory)
  6. Submitting the evidence related to marriage,
  7. Notarized copy of citizenship of witness, (two)
  8. Migration certificate if the marriage is to be registered in other places of their ancestral residence,

For any foreign nationals to conclude a marriage in Nepal the following documents in addition to Nepalese citizens shall be presented:

 

  1. No objection letter from the concerned embassy or consulate general to get married here in Nepal and this shall be translated into the Nepali language by Notary Public,
  2. Laws relating to the marriage of the respective country. Such laws should also be translated into Nepali language and notarized by the Notary Public,
  3. Copy of Passport with a valid visa,
  4. Proof of foreigner residing in Nepal for a minimum of 15 days.

Procedure for Court Marriage Registration in Nepal

  1. Fill out the application form on the concerned District Court from where the marriage is to be registered,
  2. Letter from the Ward Office that the concerned male and female going to marry are unmarried or divorced,
  3. Application can be done from the temporary residence and for this the couple must have stayed in the temporary residence for at least 15 days and the certificate of recommendation for the temporary residence shall be taken from the temporary ward office,
  4. The deed of declaration must be signed by both marrying parties accepting each other as husband and wife,
  5. If all the requirements are fulfilled and verified then after the verification by the judge the marriage certificate shall be issued by the marriage registration officer and presented in the court
  6. The issued ‘Marriage Certificate’ is provided to the concerned party.

 

So it is very easy and quick to get a marriage registered in Nepal if all the required documents and procedures are fulfilled.

According to Section 77 of the National Civil Code, 2017 and Rule 62 of the National Civil Procedure Rules, 2017, when submitting an application for registered marriage, the following documents must be submitted along with the application. Also, the registered marriage file without the documents mentioned in the details will not be accepted.

The rights of the unborn child will not be affected: If the marriage is annulled according to Section 72 or if the marriage is annulled according to Section 73, the legal rights of the child born out of such marriage or born under sub-Section (2) of Section 74 will not be affected.
